Terms of service

These terms govern your use of SimplyBooked, a booking platform operated by Nexus Labs, headquartered in Belgium. By creating an account or using the service, you agree to these terms.

1. The service

SimplyBooked is a white-label online booking platform for venues, studios, meeting rooms, sports facilities, and similar resources. It lets you set up bookable resources, take reservations from your members, and manage them via an admin console.

You retain all rights to the content you upload (logos, images, text, booking data). You grant us a limited licence to host, process, and display that content solely to provide the service. You represent that you have the right to upload anything you submit.

We may suspend or terminate accounts that violate these rules.

6. Availability

We target 99.9% monthly uptime, excluding planned maintenance and events outside our control. Status and incident history are published on our status page. We're not liable for downtime of third-party services (payments, email delivery, etc.) beyond our direct control.

7. Data processing

For personal data you upload about your members, we act as a data processor on your behalf. Our privacy policy and (on request) our Data Processing Agreement describe how we handle that data under GDPR.

8. Intellectual property

SimplyBooked, the SimplyBooked name, and the codebase are the property of Nexus Labs. These terms do not transfer any ownership rights. You may not copy, modify, reverse-engineer, or redistribute the software.

9. Warranties and liability

The service is provided "as is" without warranties beyond those that cannot be excluded by law. To the extent permitted, our total liability for any claim relating to the service is limited to the fees you paid us in the 12 months before the claim.

Nothing in these terms limits liability for death, personal injury, fraud, or anything else that cannot lawfully be limited.

10. Termination

Either of us may terminate with 30 days' notice, or immediately for material breach. On termination, we'll give you 30 days to export your data before deleting it, subject to legal retention requirements.

11. Changes to these terms

We may update these terms from time to time. Material changes will be announced by email at least 30 days before taking effect. Continued use after the effective date means you accept the update.

12. Governing law

These terms are governed by the laws of Belgium. Any dispute will be heard exclusively by the courts of Brussels, without prejudice to mandatory consumer protection rules in your country of residence.
